By using ZBEnterprises and signing up as a Client, you agree to be legally bound by these Terms and Conditions of Use, including any terms incorporated by reference. Please read these Terms carefully. If you do not accept these Terms, you may not use the ZBEnterprises service. By placing any order with ZBEnterprises, you agree to all our terms, and it is your responsibility to review them. ZBEnterprises may revise these Terms at any time by updating this posting. You should visit this page periodically to review the Terms, as they are binding on you.In these Terms, all services provided by and related to ZBEnterprises, as well as all text, images, photographs, user interface, “look and feel,” data, and other content included at https://www.zbenterprises.co (including, without limitation, the selection, coordination, and arrangement of such content) are collectively referred to as the “Website” or “Service.”

User Content and Screening

You acknowledge that ZBEnterprises may, at its sole discretion, pre-screen, refuse, or remove any project and/or user-provided content that violates these Terms or is otherwise objectionable, including content that is illegal, obscene, defamatory, or infringes on the rights of others. Activities that appear to violate the law will be reported to the appropriate authorities.

You also consent that ZBEnterprises may access, preserve, and disclose your account information and content if required by law or in good faith belief that such access is necessary to:

  • (a) comply with legal process;

  • (b) enforce these Terms;

  • (c) respond to claims of third-party rights violations;

  • (d) respond to your customer service requests; or

  • (e) protect the rights, property, or safety of ZBEnterprises, its users, or the public.

ZBEnterprises Service

  • (a) Description: ZBEnterprises is an online service where clients can post assignments and project descriptions (each a “Creative Brief”), revise those briefs (“Revision Briefs”), and receive responses (“Responses”) from design experts (“Members”). ZBEnterprises delivers the Service according to the Package you select. Responses are developed iteratively through Creative Briefs, Revision Briefs, and Responses until a final Response meets your specifications.

  • (b) Creative Briefs and Responses: You are responsible for preparing and posting detailed descriptions of your Creative Briefs, including samples and deadlines. Each Response will follow a Term Sheet outlining the terms you establish. ZBEnterprises is not obligated to review Creative Briefs or Term Sheets for accuracy, completeness, or quality.

  • (c) Reviewing Responses: You must review Responses promptly. If you do not notify ZBEnterprises that a Response is unsatisfactory, it will be deemed accepted. If revisions are required, submit a Revision Brief. ZBEnterprises will provide a subsequent Response that addresses your requested changes.

  • (d) Revision Cycles: Revision cycles allow multiple changes to refine Responses.

  • (e) Client Accounts: Clients must pay for services via credit card or other authorized methods. Payment details and receipts will be handled by ZBEnterprises. Fee policies may change, but new fees will not apply retroactively.

Registration, Password, and User Identity

  • (a) User Identity: You create a User Identity when registering, which may include industry or other personal information. Ensure you are comfortable sharing this with other users.

  • (b) Password Security: Keep your User Identity and password confidential. Notify ZBEnterprises immediately of any unauthorized use or theft. Additional security measures may be required.

  • (c) Security Breaches: Cooperate fully in investigations if unauthorized access occurs due to your account or actions.

Ownership and Rights

  • (a) Creative and Response Briefs: Upon submission, ZBEnterprises and its agents have all necessary rights to use Client Information to generate Responses and for archival purposes.

  • (b) Rights of ZBEnterprises: You grant ZBEnterprises a royalty-free, perpetual, worldwide license to use, reproduce, modify, distribute, and display Client Information as necessary to provide the Service.

Privacy and Nondisclosure

ZBEnterprises will follow its Privacy Policy, which may change over time. However, ZBEnterprises is not responsible for unauthorized access to any information submitted, including by hackers or other malicious parties.

Eligibility, Access, and Use

  • (a) Eligibility: You must be at least 18 years old and complete registration to use the Service. By registering, you represent that all information provided is accurate and that you are authorized to bind your organization, if applicable.

  • (b) Prohibited Conduct: You may not attempt to reverse-engineer software, breach security, send unsolicited communications, or interfere with the Service. Violations may lead to civil or criminal liability.

  • (c) Operation of Website: ZBEnterprises is not responsible for delays, interruptions, or errors. Availability may be affected by technical issues, and ZBEnterprises may discontinue or modify the Service at any time.

Communications

By using ZBEnterprises, you agree to receive updates, newsletters, and promotions via email or other methods. You may unsubscribe at any time. Personal information will not be shared inconsistently with the Privacy Policy.

Disclaimers and Limitations

  • (a) Responsibility for Content: ZBEnterprises does not guarantee the accuracy or reliability of information, Creative Briefs, Responses, or user content. Use of Responses is at your own risk. Clients are responsible for obtaining rights to images, photos, graphics, and other materials used in designs.
